1) About Timazi Africa & Acceptance of Terms

Timazi Africa (“Timazi,” “we,” “our,” “us”) provides educational programs, magazines, reading challenges, digital content, and related services via our websites and online shop (collectively, the “Services”). By accessing or using the Services, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the Services

2) Eligibility & Accounts

You must be at least 18 years old to create an account or make purchases. Where content is directed to high-school audiences, a parent/guardian or school must supervise access and any purchases. You are responsible for maintaining the confidentiality of account credentials and for all activities under your account.

3) Programs, Subscriptions & Donations

We may offer magazine subscriptions, reading programs, and donation options. Specific program pages list pricing, duration, and deliverables. By subscribing or donating, you authorize us to process payments via listed methods and to deliver benefits as described.

4) Pricing, Orders, Shipping & Returns

  • Pricing: Prices are listed in KES unless otherwise stated and include applicable taxes where indicated.
  • Orders: An order is an offer to buy; we may accept or decline.
  • Shipping: Estimated delivery times appear at checkout.
  • Returns/Refunds: For remote/online purchases, Kenyan consumers have statutory rights under the Consumer Protection Act, 2012, including clear terms and cancellation rights for certain remote agreements; we honor those rights and any additional return windows stated on our site.
5) Digital Content & Licensing

Unless otherwise indicated, our content (text, audio, video, PDFs) is licensed for personal, non-commercial use. You may not reproduce, distribute, or create derivative works without our prior written consent. Fair dealing exceptions under law remain intact.

6) Acceptable Use

You agree not to: 

  1. misuse the Services; 
  2. infringe intellectual property; 
  3. upload harmful code;
  4. conduct unauthorized data scraping; or 
  5. violate any applicable laws or regulations.
7) Electronic Communications & Signatures

You consent to receive operational communications electronically (receipts, notices). Electronic records and advanced electronic signatures are recognized under Kenya’s KICA and the Electronic-Transactions Regulations, 2016; contracts formed electronically are enforceable (subject to statutory exceptions such as wills/negotiable instruments). 

8) Email Marketing Consent (Opt-In Required)

  • Opt-in: Marketing emails (newsletters, promotions) are sent only if you opt in (e.g., tick box at sign-up, subscribe form). Consent must be freely given, specific, informed, and unambiguous; pre-ticked boxes are not used. You may withdraw consent at any time via the unsubscribe link or account settings.
  • Proof & Records: We retain records to demonstrate valid consent and honor withdrawals promptly. 
  • SMS/Direct Marketing: If we use SMS, we will comply with CAK rules (sender identification, opt-out, permissible hours) and the DPA consent model.
9) Third-Party Services

We may integrate payment gateways, email providers, analytics, and delivery partners. Your use of third-party services may be subject to their terms. We ensure appropriate data protection arrangements before sharing personal data with processors. 

10) Disclaimer of Warranties

The Services are provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation. Statutory rights under Kenyan consumer law remain unaffected. 

11) Limitation of Liability

To the extent permitted by law, Timazi shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Services. Our aggregate liability to you for direct damages shall not exceed the amounts you paid for the relevant Service in the past 6 months.

12) Indemnity

You agree to indemnify Timazi against claims arising from your breach of these Terms or misuse of the Services.

13) Suspension & Termination

We may suspend or terminate accounts that violate these Terms, applicable laws, or pose security risks.

14) Governing Law & Dispute Resolution

These Terms are governed by the laws of Kenya. Disputes shall be resolved amicably; failing which they may be submitted to Kenyan courts with jurisdiction in Nairobi. Electronic evidence is admissible under the Evidence Act and electronic-transactions rules. 

15) Changes to Terms

We may update these Terms from time to time; the “Last updated” date will change. Material changes will be notified via the website or email (where possible).

1) Who We Are

Timazi Africa is the data controller for personal data processed via timazi.org and related Services. We comply with Kenya’s Data Protection Act, 2019 (DPA) and the Data Protection (General) Regulations, 2021. We follow ODPC guidance notes on consent and sectoral guidelines. 

2) Personal Data We Collect

Depending on your interactions, we may collect:

  • Identity & contact: name, email, phone, postal address (e.g., subscriptions/deliveries).
  • Account: username, password, preferences.
  • Transaction: orders, donations, payment confirmations (processed via third-party gateways).
  • Program participation: school/teacher details when organizations enroll.
  • Communications: your requests, support messages.
  • Technical: device/browser information, IP address, usage data, cookies.

3) Lawful Bases for Processing

We process data on the following bases under the DPA:

  • Consent: email marketing; certain cookies; optional program communications. 
  • Contract performance: fulfilling orders, subscriptions, deliveries. 
  • Legal obligations: tax, accounting, fraud prevention. 
  • Legitimate interests: site security, service improvement (balanced against your rights). 
4) Marketing Emails (Opt-In; Unsubscribe Anytime)

We send marketing emails only with your explicit opt-in. Consent is freely given, specific, informed, and unambiguous, and you can withdraw it anytime via the unsubscribe link or by contacting us. We will stop marketing upon withdrawal unless you re-opt-in. We maintain evidence of consent and withdrawal per ODPC guidance.

5) Cookies & Similar Technologies

We use essential cookies for site functionality and (with consent) analytics/marketing cookies to measure engagement. Where consent is the basis, we show a cookie banner with clear choices and respect your preferences. 

6) Children’s Data

Where we process data in school programs, we work with schools/parents/guardians to ensure appropriate consent or another lawful basis and implement safeguards when processing children’s data, following ODPC guidance. 

7) Sharing & International Transfers

We share personal data with:

  • Service providers (email delivery, payments, logistics, analytics) bound by contracts and confidentiality.
  • Regulators or law enforcement where legally required.
    If data is transferred outside Kenya, we use safeguards required under the General Regulations (e.g., adequacy or appropriate safeguards) and inform you where applicable. 
8) Data Retention

We retain data only as long as necessary for the purposes collected and in line with legal obligations (e.g., tax records), after which we delete or anonymize it. 

9) Your Rights

Under the DPA, you have the rights to: access, rectification, erasure, restriction, objection (including to direct marketing), data portability, and to withdraw consent at any time. You also have the right to lodge a complaint with the ODPC. We provide mechanisms to exercise these rights and will respond within statutory timelines. 

10) Security

We implement appropriate technical and organizational measures to protect personal data (encryption in transit, access controls, staff training). We monitor processors’ compliance and perform due diligence. 

11) Data Breaches

We assess, document, and, where required, notify the ODPC and affected individuals within prescribed timeframes after becoming aware of a personal data breach, consistent with the General Regulations. 

12) Direct Marketing via SMS

If we send promotional SMS, we will: obtain prior consent; identify the sender; include a clear opt-out; and respect time-of-day restrictions and other requirements established by the Communications Authority regulations and industry guidance. 

13) Electronic Records & Evidence

Electronic communications and signatures used in our Services are legally recognized. Electronic records may be used as evidence in Kenyan courts
